The Montana Attorney General released a report in late February, stating that BNSF controls 95 percent of rail transportation in Montana (including grain). The report concludes that this high level of concentration results in Montana shippers paying the highest rail rates in the country and often receiving poor rail service.
The report was issued in response to concerns raised by Montana's legislature in 2007. BNSF claimed the report was based on outdated data.
